In accordance with the consumer protection (Distance Selling) Regulations 2000 and the data Protection Act 1998 When buying goods on the Internet or mail-order you are entering into a legally binding contract the terms of which are detailed below. Any variations of the agreed terms are only applicable if details of which are provided on the individual contract. Definitions Buyer the person who buys or agrees to buy the goods from the seller. Conditions the terms and conditions of sale as set out in the document and any special terms and conditions agreed in writing by the seller. Goods the articles which Buyer agrees to buy from the seller. Seller Means Garden Buildings Centre - Chesterfield Conditions These Condition shall form the basis of the contract between Seller and Buyer in relation to the sale of Goods, to the exclusion of all other terms and conditions including the Buyer’s standard conditions of purchase or any other conditions which the Buyer may purport to apply under any purchase order or confirmation of order or any other document. All orders for Goods shall be deemed to be conclusive evidence of the Buyer’s acceptance of these Conditions. These Conditions may not be varied except by the written agreement of a representative of Garden Buildings Centre - Chesterfield These Conditions represent the whole issue of the agreement between the Seller and the Buyer. They supersede any other conditions previously issued. Payment All goods must be paid for in full at the time of ordering unless terms have varied by prior arrangement. Payment is in GBP pound sterling by most acceptable methods including credit/debit card, cash, and cheque. VAT is applicable at United Kingdom rates. Businesses within the European Union that can supply a valid VAT number are responsible for payment of VAT or equivalent taxation any their own country rates. Businesses outside of the realms of the EU shall be responsible for both import tariffs and taxation. Interest on overdue invoices shall accrue from the date when payment becomes due calculated on a daily basis until the date of payment at the rate of 8% per annum above the Bank of England base rate from the time to the time in force. Such interest shall accrue after as well as before any judgement. We will exercise our statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if you do not pay us in accordance with our agreed terms. We reserve the right to make a change for delivery for goods outside of mainland England and Wales, or for accompanying products which compliment a full order. All goods remain the property of Garden Buildings Centre - Chesterfield until payment is received in full. The risk in all goods supplied by us shall pass to the buyer at the time of delivery, notwithstanding that the goods remain the property of Garden Buildings Centre - Chesterfield until paid in full. Contract payments The contract sum shall be paid in installments as detailed at commencement of works; payments will correspond to the value of work already completed. If you fail to make these payments within 14 days of invoice, we shall be entitled to cease work on written notice to you. You will remain liable for any outstanding costs and loss of profit. If the proposed works do not finish on the agreed date and the delay is entirely due to the actions and/or omissions of the customer or his agents or tenants, the customer will indemnify the company for any loss of earnings as a result of the delay. Credit Accounts We will be pleased to open credit accounts on receipt of satisfactory bank and two trade references. Delivery We will endeavour to deliver within 30 day period, although leads times will vary according to season. If we cannot deliver the goods within this time, we will inform you and agree on another time for delivery. If we cannot agree on another time, we will offer a full refund. Where delivery dates are given, they are without liability and time is not the essence of contract. Unless otherwise stated, our prices are inclusive of delivery mainland England, Wales and some parts of Scotland. We reserve the right to levy additional costs for items ordered when supplied separate to building unless otherwise stated. Damage/Faulty & Shortage All goods delivered must be examined for damage and/or shortage and any damage or shortage must be reported to Garden Buildings Centre - Chesterfield in writing within a reasonable length of time, determined by the nature of the problem. Complaints Will be acknowledged with 48 hours and dealt with according to each manufacturers own guidelines in a fair and confidential manner. The buyer will be kept fully informed during the process of resolving the issue by phone and/or email. If replacement goods are required in order to rectify any default or deficiency, this should take no longer than 10 working days. Cancellations Should for any reason you wish to cancel your order. This must be done so in writing no later than 7 days after receiving the goods or within seven working days from order. The buyer maybe responsible for the costs of returning goods unless your reasons are validated by this office. Before goods are returned, the cost must be validated by The Conservatory Centre - Chesterfield Mistakes in bills, receipts or payments Any mistakes in bills, receipts or payments will rectified as soon as possible, and at latest within 30 days of agreeing to do so. Refunds When the situation arises; a refund will be made as possible and at the latest, within 30 days of agreeing to give the refund. Data Protection We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). The type of information we will collect about you includes: Your name, address, Phone number, email address, credit/debit card details and marketing details. The Data Controller is responsible for the upkeep of this information and can be contacted by ringing 0870 7465 190. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. We will never collect sensitive information about you without your explicit consent. If you find any inaccuracies we will delete or correct it promptly. We will not transfer personal information about you outside the European Economic Area without Prior consent. We will give you the chance to refuse any marketing email from us or from another trader in the future. Some of the features on our website require the use of “cookies” – small text files that are stored on your computer’s hard drive. This enables us to continually improve the website to meet the needs of our users. Breach of these terms In the event of the Buyer being in breach of any of these conditions, Garden Buildings Centre - Chesterffield shall be entitled to refuse supply the buyer with any further goods, or suspend delivery until all breaches have been remedied. Specifics relating to timber buildings All buildings dimensions shown on this website are approximate, based on external wall sizes. Always make allowance for any roof overhang when buildings have to go into confined spaces. We would like to remind the customer that timber is a natural product subject to variance, movement and colour changes. Any guarantees offered on timber products is subject to reasonable care and maintenance. Note, specifics on individual timber preservatives and additives if any will be supplied upon request. None the above affects your statutory consumer rights. English Law shall govern these terms and conditions. |
